“M ediation is a well established process for resolving disagreements in which an impartial third party (the mediator) helps people in dispute to find a mutually acceptable resolution”
HM Courts Service website
As we have a vested interest in promoting the idea of mediation in general and our service in particular, we thought it might be more persuasive if, instead of singing mediation’s praises ourselves, we start by quoting a Law Lord, Lady Hale of Richmond:
“Section 1 of the Family Law Act 1996 says that when a marriage has irretrievably broken down, it should be brought to an end
- first with the minimum of distress to the parties and the children affected,
- second with questions dealt with in a manner designed to promote as good a continuing relationship between the parties and any children affected as possible in the circumstances, and
- third without costs being unreasonably incurred
and mediation is an excellent way of trying to achieve all three of those objects.
